These are the terms of our sale. Please read thoroughly as you will be required to sign this form stating that you understand and will abide by these terms.
Auction Rules and Terms of Sale
All Bidders and others attending this auction, agree that they have read and fully understand these terms and agree to be bound thereby.
All purchasers are required to have a bidder’s number to bid. Purchasers must present identification and give their correct name, address, and phone number as well, to obtain a bidder’s number. A cash deposit of $100.00 is required of everyone to obtain a bidders number. This deposit WILL be applied to your purchase or, if no purchase is made,it will be fully refunded before you leave the sale. No children under 12 years of age allowed.
Full payment shall be made by CASH, CREDIT CARD, OR COMPANY CHECK W/LETTER OF CREDIT FROM BANK FROM WHICH IT IS DRAWN.
The descriptions of items at or prior to the sale are believed to be correct. However, neither these descriptions nor any oral statements made by Worstell Auction Company, it’s agents, employees, or the Auctioneer, concerning any item shell be construed as warranty, either expressed or implied. All items are sold "As is-Where is". There will be a merchandise inspection period the day before the sale during the hours of 8:00 AM until 4:00 PM. You are strongly advised to examine the merchandise before bidding. Buyer must pay for all items he is declared high bidder on, before leaving the day of the sale.
Merchandise becomes the full responsibility of the purchaser once declared the high bidder. Buyer must pay for all merchandise and assumes all responsibility for loss and/or damage of purchased merchandise. Neither Worstell Auction Company nor the Auctioneer shall be responsible for the buyer’s merchandise.
A receipt is furnished to the buyer at the time of sale. Worstell Auction Company will have auction employees posted at all exits immediately following the end of sale. You must present your receipts to these employees before you are permitted to remove any items you have purchased from the sale. Lot numbers must remain on all merchandise for verification prior to removal.
Bidder acknowledges responsibility for any personal injury or property damage caused by the bidder or his agent, and further agrees to hold the Auctioneer and Worstell Auction Company, their officers and employees harmless for any personal injury to himself and any property damage incurred on the sale property.
The Auctioneer reserves the right to group lots, make smaller lots, and or delete lots, as well as to offer individually or by group. The Auctioneer shall determine the advance of bidding.
The Auctioneer reserves the right to make statements that will take precedence over any printed matter or prior statements.
In the case of tie bids, the Auctioneer shall reopen bidding. The designation of the buyers will be final.
The deadline for picking up any items is Tuesday, 4:00 PM after the sale. Any merchandise not picked up by the deadline will be considered abandoned property, and Worstell Auction Company may at it’s discretion, resell or donate this merchandise without refund to you.
Pick up schedule:
Auction day; 2 hours after close of sale
Sunday: 8 AM – 12 PM
Monday & Tuesday: 7 AM – 4 PM
Buyers are prohibited from reselling and/or trading merchandise on the property.
All sales are FINAL. A 15% buyer’s premium will be added to the sales totals.
Please allow 45 minutes from the time you purchase an item for the sale to be posted.
Shoplifters will be prosecuted to the full extent of the law.
The Auctioneer or Worstell Auction Company will resolve any disputes that may arise.
